CAPE SIDECAR ADVENTURES OVERLAND TOURS UNABRIDGED TERMS & CONDITIONS
TOUR OPERATOR & CONTRACT
All tours are operated by Cape Sidecar Adventures (‘CSA”) whose office is a 1 Dickens Road, Salt River, 7925. Cape Town, South Africa
All bookings are made on a first come first served basis. Guests are the person(s) listed on the SIDECAR OVERLAND BOOKING FORM. All guests are required to sign the booking form & the T&Cs or complete the on-line booking form accepting these T&Cs. CSA reserves the right to decline any booking at their discretion. Any variation of the terms of this contract needs to be in writing.
A 25% deposit is required to secure the booking. Deposits are refundable up to 6 months prior to the tour. After this date deposits are non-refundable and non-transferable irrespective of circumstances. 75% balance is due 6 weeks prior to the booking. Bookings made within 6 weeks of the tour departure date will only be accepted with full payment.
Tour price includes all services and supplies as listed in the “What’s included” page. Anything not listed as included is excluded. All accommodation is priced on a sharing basis. Guests who book as singles will be expected to cover the single supplement charge.
AMENDMENTS TO TOUR
Guests who wish to make changes to the planned itinerary may request personal amendments up to 8 weeks prior to departure. Changes will be made at the discretion of CSA.
Rates are correct at the time of printing/publication. If circumstances arise beyond our control that result in an increase in costs eg: currency fluctuation, taxes, fuel costs etc we reserve the right to pass on these surcharges provided they occur more than 6 weeks prior to departure.
As tour arrangements are made many months in advance, it may be necessary to make minor changes to the itinerary. If significant changes to the tour are necessary (eg: changes in dates, accommodation or major changes to the itinerary) the guest can choose to continue with the revised tour or accept an offer of an alternative tour of the same value or elect to cancel the booking with a full refund.
Where issues with the guest’s personal travel plans have resulted in a delayed or non-arrival at the start of the tour, CSA will not be responsible for any financial or other compensation for any additional costs incurred. CSA will not provide a refund for any part of the tour missed.
In the event of force majeure (included but not limited to war, riots, civil disturbances, unavoidable technical problems with transport, fire & adverse weather conditions), refunds or compensation cannot be made and guests will be responsible for all their own financial & other requirements
All rider guests must have the following documentation in their possession at all times during the tour:
- Valid biker license
- Personal & travel insurance
- Passport with South African customs entry stamp (for overseas visitors)
The following are the T&Cs for sidecar hire:
- Copies of all the abovementioned documents will be kept on record by CSA
- Sidecars are hired subject to availability
- Minimum rider age is 25yrs. Max rider age 70yrs.
- Guests can choose to increase the minimum 3rdparty insurance already in place
- Any one-way hire fees are included in the tour cost
- No fuel is provided with any sidecar hire.
- Accessories provided will include helmet, leather jacket, goggles, complimentary bandana.
- All guests will be required to lodge a damage/accident excess deposit of R15,000 prior to departure. Guests will also be responsible for further charges as stated below:
- Fees for late return
- Fees for not returning sidecar with a full fuel tank
- Costs of upgrading insurance cover
- Any additional accessories required
- Damage or non-return of accessories.
CSA is responsible for ensuring that the 3rdparty supplier of services and accommodation during the tour is of an acceptable standard. CSA cannot be held responsible for some amenities being affected by weather conditions or mechanical breakdowns. CSA cannot be held responsible for death, personal injury or illness caused by engaging in activities outside the tour itinerary. CSA cannot be held responsible for death, personal injury or illness cause unless we are proved to be negligent.
CSA reserves the right to cancel a tour if the minimum number of bikes needed is not met. In such a case, the guest will be offered an alternative tour of similar value or a full refund. Notification will be given 6 weeks prior to departure. CSA will not be responsible for any costs or losses incurred by the guest due to the cancellation of the tour. This includes the cost of pre-paid airline tickets & hotel accommodation.
CANCELLATION OR CURTAILMENT
If a guest cancels a tour, the following charges will be levied:
- Your deposit is refundable up to 12 weeks prior to the tour. After this period the deposit is non-refundable & non-transferable.
- More than 6 weeks and less than 12 weeks, 50% of tour cost
- Less than 6 weeks, 100% of tour cost.
If, for any reason, the guest decides to curtail a tour during it’s duration, no refund will be made.
TRANSFER OF BOOKING
If a guest is unable to travel the booking may be transferred to a 3rdparty subject to prior approval by CSA. In such cases, 2 weeks notice should be given any charges incurred in the change will be for the account of the guest.
CSA is a bonded member of SATSA (South African Tourism Services Association) and the guest is afforded financial protection in the event of CSA becoming insolvent or ceases to function. Details of this protection is available on request.
Should a guest feel that CSA has not met it’s obligation, it should first be brought to the attention of the accompanying tour leader/guide. If the guest remains unsatisfied, any comments should be put in writing, quoting your tour name and tour dates and emailed to firstname.lastname@example.org for the attention of Tim Clarke.
